This is a multi-part message in MIME format. ---------------------- multipart/alternative attachment QUESTION: I am a passport holding canadian teacher currently living and working in the UK under the auspices of a uk certificate of entry thanks to my UK-born mother. 1. where/how must I pay taxes? I would rather file in canada because I have student tuition credits there... does this mean I can somehow get back the income tax I'm getting here? 2. can I apply for us citezenship/visas considering my father was a US citizen until he moved to canada in 1969? I believe he became a canadian around 1975. Thanx ============================================================================ david ingram replies: 1. Your first liability is to the UK because you are there as a UK person and not as an exchange teacher. You may or may not have a tax liability to Canada. However, under Article IV of the UK Canada Income Tax Convention, I would bet that your only tax liability is to the UK. And, even if you did decide to file a Canadian Tax return, you would still pay full tax to Great Britain first. 2. How old was your father when he came to Canada. If he was over 19 you are a US citizen. He might think that he lost his US citizenship because up to Feb, 1977, Canada required a new citizen to revoke any prior citizenships. That was changed and unless the US government issued a "loss of citizenship" document to your father, he is still and "was still" a US citizen after becoming a Canadian although he had every reason to think he was not a US citizen any more. If he was only 18 or 19 when he came to Canada, you are not a US citizen but under the right circumstance, he can sponsor you to the US as a resident alien. To do so, he would have to file six years of back US tax returns. goto www.centa.com and print out and read the October 1993 newsletter about dual citizenship Hope this helps David Ingram's US/Canada Services US/Canada/Mexico Tax Immigration & working Visa Specialists US / Canada Real Estate Specialists 4466 Prospect Road North Vancouver, BC, CANADA, V7N 3L7 Calls accepted from 10 AM to 10 PM 7 days a week Res (604) 980-3578 Cell (604) 657-8451 Bus (604) 980-0321 [email protected] www.centa.com www.david-ingram.com Disclaimer: This question has been answered without detailed information or consultation and is to be regarded only as general comment.
