Immigration and work in usaHi David, Your website was an enormous help when my wife became a PR of Canada 2.5 yrs ago. (She is a US Citizen I am a Canadian Citizen) She is going to take out her Canadian citizenship (3yr residence is in October) before we make any moves but we are discussing the idea of moving to the Oregon coast. I would think she can move back at any time but was wondering about how I could go about moving there and be able to work immediately upon arrival. We have been married for 2 yrs and common law for 2.5yrs. Your help as always would be much appreciated. Also a second question, if I may. My wife works for a Canadian company, which has been contacted by another Canadian company who is doing some real estate development in Seattle. They want to send my wife to do some work on the project in Seattle because she is American and they are having a hard time getting a work visa for anyone else. This seems a little bit to simple to me and am wondering if this is possible as well as what tax / immigration implications will be brought onto her THNX ===================================== david ingram replies: Have her get her citizenship first. That leaves you free to move to the USA. If you move, she will have to sponsor you as a spouse and you will have to do the paperwork in Montreal. It will take anywhere from 6 to 18 months. NAFTA visas can be issued in a day or two. Marriage is very different and there are two directions you can take with both requiring your fiancée to sponsor you. 1. She can sponsor you as a fiancée which can be done through Vancouver. When approved, you get to go to the US and have to be married within 90 days. No marriage, you have to return to Canada. It is taking from 104 days to a year for a fiancée visa right now. The distinct advantage is that you can do the paperwork in Vancouver. Goto http://uscis.gov/graphics/howdoi/fiance.htm for US government directions. Your fiancée will need to fill in Form I129 at http://uscis.gov/graphics/formsfee/forms/i-129f.htm 2. You can get married first in Canada. Then you have to do the paperwork in Montreal which is pretty inconvenient for a North Vancouver boy. goto http://uscis.gov/graphics/howdoi/spouselive.htm for US government directions. This is taking up to two years at the moment as I understand - You would file form I-130 at http://uscis.gov/graphics/formsfee/forms/i-130.htm The Third choice is to cross the border and get married in the US. The distinct disadvantage of this is that it can then take a couple of years for you to get permission to work. Not recommended. Last, but not least, to sponsor you, your fiancée has to PROVE sufficient income and file fork I-864, an "Affidavit of Support" found at http://uscis.gov/graphics/formsfee/forms/i-864.htm The 2006 guideline would mean that she would have to be able to show an income of $16,500 US to sponsor you. When she files the application, she has to produce certified copies of her last three years of income tax returns. You can find the income guidelines on form 864P at http://uscis.gov/graphics/formsfee/forms/i-864.htm Last, but not least, if her income is not sufficient, she may be able to provide support through assets. If there are no assets, another family member may file an 864A which is a co-support form. Good luck. These are complicated because of the back and forth foreign tax credits. - The IRS says a foreign tax credit takes 1 hour and 53 minutes. $1,500 would be the minimum with a rental or two in the country you do not live in or a rental and a business and foreign tax credits no move in or out $2,000 would be all of the above and you moved in and out of the country. This is just a guideline for US / Canadian returns We will still prepare Canadian only (lives in Canada, no US connection period) with a three or four slips and no capital gains, etc. for $125.00 up. With a Rental for $300 A Business for $300 - Rental and business likely $400 And an American only (lives in the US with no Canadian income or filing period) with about the same things in the same range with a little bit more if there is a state return. Moving in or out of the country or part year earnings in the US will ALWAYS be $400 and up. TDF 90-22.1 forms are $25 for the first and $10.00 each after that when part of a tax return. 8891 forms are generally $50.00 to $100.00 each. 18 RRSPs would be $900.00 - (maybe amalgamate a couple) Capital gains *sales) are likely $50.00 for the first and $20.00 each after that.
