I am not sure if you can set me straight or not. I recently
heard that I may not have any claim as a commonlaw wife as I
never got divorced from my previous husband. We separated in
Sept. 1992 but never went thru with a divorce. I have been living
with a man since 1997 and as I said, I was recently told that if
something should happen to him I have no status as his common law
wife. We have no wills and he is not interested in making one up
I would appreciate any help you can give me. I already know the
will issue has to be sorted out but it is the commonlaw thing
that is bothering me. We own a home together as well as other
things. The house is in both of our names.

Although I would love to try and answer this for you, the rules
for common-law marriages are so different from province to
province and state to state that you need a local family lawyer
to talk to.
Ask a couple of friends for the name of their favourite family
lawyer and go and spend $300 to $500 and get your rights and
non-rights spelt out for you.
If you do not have anyone, I think that you are a BC native and
you could call David Bellamy at (604) 662-8900 - He was a very
good representative for me in my recent divorce.
A word to the wise however. Get your divorce now and clean up
the past for your own sake.
