Volunteering in the USA -
Dear Mr. Ingram: We own a membership at a campground set up as a non = profit corporation in XXXXX State. We are unsure of what the rules = are in regards to helping out with spring cleaning and maintenance on = the park grounds. Every year members are asked to participate with a = general clean-up. We are also wondering what are the rules in regards = to Canadian members being elected to the Board of Directors; this is a = volunteer position. Could our Nexus card be in jeopardy by us donating = our time and energy to these tasks as Canadian citizens in the United = States. That being said, I have not heard of a single case where the INS (past) or Homeland Security has prosecuted anyone for being on the executive of their campground or Strata Council. On the other hand I know the actual people who were jailed or deported for transporting a ladder from a store to their construction site (took a job away from a US truck driver) and sweeping up their own warehouse floor. I would worry more about being in the clean up crew for the campground. In one case where I knew the person, my client, the president of the council (a Canadian) fired the complex handyman. The handyman went to Homeland Security to complain that this "Canadian" had fired him and was "working" as head of the strata council. The results? Well the handyman's wife was found to be in the United states illegally and "she" was deported. I lost track after that. I heard rumours that he had been charged with violating the Immigration Laws himself but had no verification. So, do not have an official answer for you. Why not write to Homeland Security on the Campground letterhead, explain the situation and ask for some sort of ruling. THEN. if you get a reply, make sure I get a copy.
