Working in USA on K1 Visa?
Date: Tuesday March 28, 2006 Time: 10:22 AM -0800 QUESTION: I just moved to the USA on a K1 visa from Canada (will be getting married at the end of next month). According to the US consulate I need both a Social Security card and an Employment Authorization Document in addition to my K1 visa to work in the United States. My Canadian employer would like to transfer me to a US office once the paperwork is complete so I can continue my old job. What I am wondering is this...other than possible tax complications, is it legal for me to work for the Canadian office while I'm waiting for my EAD or do I still need an EAD since I'm now living in the USA? Right now I'm on unpaid leave. Thank you. -------------------------------------- david ingram replies: As long as you are working for your Toronto employer on-line from home, there should not be any problem. However your tax liability will be to the USA - NOT Canada - Make sure that your Canadian employer does NOT deduct EI, CPP or Canadian Income Tax. When filing your 2006 joint return with your husband, you will need to fill out a Schedule C. -------------------------- David Ingram's US / Canada Services US / Canada / Mexico tax, Immigration and working Visa Specialists US / Canada Real Estate Specialists My Home office is at: 4466 Prospect Road North Vancouver, BC, CANADA, V7N 3L7 Cell (604) 657-8451 - (604) 980-0321 Fax (604) 980-0325 Calls welcomed from 10 AM to 10 PM 7 days a week Vancouver (LA) time - (please do not fax or phone outside of those hours as this is a home office) email to taxman at centa.com <mailto:taxman at centa.com> www.centa.com <http://www.centa.com/> www.david-ingram.com <http://www.david-ingram.com/> Disclaimer: This question has been answered without detailed information or consultation and is to be regarded only as general comment.
