Transferring some of the ownership to a son - ask
My question is: Canadian-specific QUESTION: Is there capital gains tax payable when a son is added to the title of a property (summer cottage) as a joint tenant with the parent? The parent being the original owner. The land value has increased greatly since the parent purchased it. If there is capital gain tax will it be based on the whole value of the property. --------------------------------------------------------------------------- david ingram replies: If your intent is to give your son ownership and value, then there is a disposition and capital gains tax would be payable on the value of his share. As an example, if you had paid $50,000 and it is now worth $200,000 there would be a $150,000 capital gain to this point. Giving him 1/3rd of the property would mean that you had effectively disposed of one third of the $150,000 and would owe tax on the $50,000 profit. Since only 1/2 of capital gains is taxable, you would be adding $25,000 of taxable capital gains on line 127 of your Canadian T1-General Income tax Return. On the other hand, if you were merely adding his name for the purpose of avoiding or reducing future probate fees upon your demise, there would be no capital gains tax to pay at this time. You would need a separate document that your son had signed. this document would acknowledge that his name was going on the title for probate purposes only and that he does not consider the property to be half his and he will not pledge it as security or make any attempt ask a court for partition so that he could sell his share. If he is married, his wife should acknowledge the fact as well. If he is unmarried and gets married in the future, his new wife should sign off any claim to the property (until your death) if their marriage breaks up. I likely have a dozen situations at any one time where there is a marriage break-up involving the son or daughter whose parents have put them on the title of the parent's home or cottage or business or all three and the departing daughter or son in law wants their half of the share of the parents' property.
