QUESTION:
Hi,
If a person is coming to the US from Canada to work with a TN visa, what tax
forms will they have to fill out. What state taxes will they pay, since it
is normally the state that they live in. We have one consultant going to Ca
and one going to AZ both from Canada with TN visas.

The TN holders will fill out his or her departing Canada T-1 General and
have to pro-rate his or her exemptions in Canada.
He or she then has a choice of filing a 1040NR for the first year or filing
a 1040 in one of two ways:
1. they file as a dual status person which means that they "HAVE TO" must
itemize deductions and can NOT claim the standard deduction or
2. file (if married) a joint US 1040 and include their Canadian income and
claim the standard deduction and a foreign tax credit for the tax paid to
Canada. # 2 usually results in significantly less tax.
For ARIZONA they would file a 140 or 140NR and for California they would
file a 540NR
