Canadian and UK Pensions received by US resident. ask
My_question_is: Applicable to both US and Canada Subject: Canadian Pension Expert: taxman at centa.com Date: Wednesday September 14, 2005 Time: 05:45 AM -0700 QUESTION: I am moving to the US and marrying a US citizen. I have no property or assets in Canada but receive CPP plus UK pensions ( I am 65). I have no other source of income in Canada but intend to work in US. Will I be taxed on my pension earnings here and/or in the US? I have canadian drivers license, Ontario medical and car registered here. Do I give these up and re-register my vehicle in US or does that not make a difference? Do I have to declare US earnings to Canadian Government and be taxed on them? What is my best course of action to minimize taxes? Many Thanks ========================== david ingram replies: The UK pension will only be taxable in the USA. If the UK pension is social security, the UK social security is taxable in the US only under Article XVII(3) of the US / UK Income Tax Treaty. Both Canada Pension Plan and Canadian OAS (Old Age security) are only taxable in your country of residence under article XVIII of the US/ Canada Income Tax Convention and amending protocols. If you have left Canada and are now a resident of the US, none of your US earnings will be subject to Canadian Income Tax under Article IV of the US / Canada In come Tax Convention. When you move to the US, your Ontario Medical and Hospitalization plans officially cease to be effective after 90 days. Depending upon what state you move to, you usually have about 30 days to get a residential driver's licence. I believe (but am not sure and someone might want to correct me) that your Ontario motor vehicle licence is officially cancelled (even if you still have it) when you have removed the car from Ontario after 60 days - please do not take this as gospel. Check it yourself. For instance, I just bought a car in Oregon and imported it into British Columbia on Wednesday Sept 14 (yesterday morning). When I bought it in Pendleton, Oregon on August 30th, the Oregon plates and registration went with the car. The paperwork clearly showed that the seller had ten days to notify the DMV (Department of Motor Vehicles) that he had sold the car. I, the purchaser, had 30 days to register it in Salem Oregon or at any Oregon DMV office. To get the car into Canada, I had to fax the documents to the US border office to get it officially exported. they had to have the paperwork for 72 business hours before I could export the car. Then when I showed up at 1 AM, I found out that it could only be exported between 8 AM and 3:30 PM at the Blaine office. Other crossings may be different. Get your facts straight before you go and realize that you should check with the manufacturer of your car to be sure that your car qualifies to be imported into the United States and if you happen to be moving to California, it has to qualify for California Emissions as well. =========== Answers to this and other similar questions can be obtained free on Air every Sunday morning.
