QUESTION:
Hello,
I am a single mother of twin sons. I want to move to Chicago. The boys have
there fathers last name. He has been in jail for trafficing cocain, and has
not seen the kids, or has suppoted them finacally. I have met a guy who is a
Doctor and we would like to live together. Does the father have a right to
stop me from moving? If so what steps can I take?

This is not the forum you need to get the results you want. I am not a
lawyer and you have too specific a problem to take an answer from me and
just act on it.
1. You cannot just move to Chicago to live alone or with a boy friend. To
move to the US, you need a visa of some sort. That visa could be a working
TN visa under NAFTA if you have a recognised profession. An exception would
be if your own mother or father was /is a US citizen and you have inherited
their citizenship.
2. The visa could be a fiancée visa in which case your boyfriend has to
apply for it. In this case, you "HAVE" to be married within 90 days of
moving to the United States.
3. In spite of the fact that the boys' father has not seen them or paid any
support, he still has to give written permission for you to take the boys
out of their provincial jurisdiction. OR, you need A COURT ORDER.
Last Sunday, I was served similar papers as a representative of a father of
a 13 year old boy. In this case, the father has never seen the son or paid
any support and the mother's new husband wants to adopt the boy.
If you are in Vancouver, I suggest that You might want to contact Carey

who are trying to get to see their children. No one in the province of BC
