Ottawa Resident’s US / Canada Income Taxes - Ask an International real estate mutual funds immigration income tax expert
QUESTION: I am looking for somebody to help me with my current tax situation. I have to file both US and CDN taxes because I work for a US based company but reside in Canada. I am currently behind in the CDN taxes as I originally felt I only needed to do the US taxes. So I need somebody who specializes in both countries taxes. Do you have any offices in Ottawa? Thanks ================ david ingram replies: If you are living in Canada and "working" in Canada, you should/would not do a US return. If you are working in the US, have applied for the magical “green card” and returning to Canada to visit your family who are waiting to join you in the US, you likely do not have any Canadian Income Tax liability although you should file a Canadian return as a “factual resident”. You would file a Joint US return even if your family was not yet in the US. (I will bet that you filed a 1040NR) If you have no intention of everyone moving south and you have not filed a green card application and do not intend to do so, you would file a US 1040 or 1040NR and then report the same income in Canada and calculate your Canadian Tax liability. You would then get (usually) a dollar for dollar credit in Canada for the state and federal income tax, social security and Medicare taxes you paid in the US. I used to have an office and a good US tax preparer by the name of Gary Gauvin at 310 O’Conner in Ottawa but Gary has moved to Texas and I no longer have anything to do with the office which still has my name on it and has moved to 329 Waverly. To my knowledge, that office has no US ability at this time. However, I look after some 500 US / Canadian returns by email, snail mail, fax or courier and would be glad to look after yours if you should desire.
