When we retire in = a few years we would like to live 6 months in US and 6 months in Canada. = I have a small amount of retirement and I understand there is some legal = papers I need to fill out (something like a QTip-Trust) so I do not have = to give 1/2 my retirement to Canada if I were to pass away. Or in other = words what happens to my retirement if I put it in a Canadian Bank? = Would 1/2 go to the Canadian government when I pass on? Could you please = give me some direction? Espically if we buy property in Canada.......=20 ----------------------------------------------------------------- david ingram replies: Any American can spend up to six months a year in Canada without an = official visa as long as the American maintains a residence in the US at = the same time. The same is true in reverse. The Canadian who maintains = a home in Canada can spend up to 6 months in the US as a visitor. =20 The Canadian who averages (loosely) slightly more than four months a = year in the US becomes responsible to file a US tax return or an = exemption form when they exceed the 183 day rule although if it is a = technical infringement, they can still claim a closer connection to the = US form and escape US tax. In your case, I would leave my money in the US and plan on being in = Canada less than 170 (to be sure) days a years. That gives you a couple = of weeks leeway in case something comes up. Article IV (2) a, b, c and d of the US / Canada Income Tax Treaty would = take over. I recreate that part of the treaty here. =20 Article IV - Fiscal Domicile - (it is the same number in most treaties) = For the purposes of this Convention, the term "resident of a Contracting = State" means any person who, under the law of that State, is liable to = taxation therein by reason of that person's domicile, residence, = citizenship, place of management, place of incorporation or any other = criterion of a similar nature, but in the case of an estate or trust, = only to the extent that income derived by the estate or trust is liable = to tax in that State, either in its hands or in the hands of its = beneficiaries.
