L2 - SSN or Tax identification # ? Calgary Vancouver
This is a multi-part message in MIME format. ---------------------- multipart/alternative attachment David My wife and I got married end of August in Calgary, My L1-B was up for renewal in a couple of months so the lawyers put together the paper work to get me a L1-A (change in job scope), which took until October. We also had to wait until October for our marriage license to show up. My wife then entered the US Mid November and obtained her L2. We then submitted her application for work authorization in the US (takes 3-6month... still waiting). My wife returned to Canada end of November moved out of her apartment and stayed in Toronto for a week before going to Calgary to stay with her parents for the holidays. She entered back into the US near end of January we when got possession of our condo. Questions: 1. How will you file her taxes for Canada (full year or up until departure in Nov?) She also has some MTS stock (small amount), non-interest bank (joint account with her mom) and mastercard.... any of these a problem? 2. Can I claim her as a dependant on my US taxes since we were married in August? Should she be going to get a social security number now or wait until she gets work authorization? I am just getting my takes info together to sent off to you.... is there any addition information I should (exact dates etc..... ) to help you file our taxes. Thanks Todd Smith _________________________________________________________________ david ingram replies: Your wife is a resident of Canada for the year for tax purposes. This will give her full personal exemption amounts. However, she is also your wife so we will file a joint US return for you and that will save you significant US taxes. We will claim foreign tax credits for her taxes paid to Canada If she does not have her work authorization and a SSN by the time we file, we will file under the new Dec 17, 2003 regulations for an ITIN and include a W7 form with the return. OR I suggest that we file for an extension for the return. That means that we do not HAVE TO file the US return until Aug 15th. By then, your wife will have her work authorization AND an SSN. david ===================================== Answers to this and other similar questions can be obtained free on Air every Sunday morning.
