QUESTION:
Hi David,
I was wondering what constitutes proof of employment for the purpose of
gaining a TN for a management consultant. I have heard that letters from
former employers work, but what happens if those employees no longer work
for the same firm or if the firm has either changed names or ceased
operations? I have many people willing to vouch for my experience at past
employers, but all have gone on to better jobs and in two cases the
companies have ceased operations. I do have a bachelors degree, but it is in
French and I cannot imagine how this relates to the position I have been
offered.

The TN Management Consultant visa is / was the most abused of all the US visas.
A TN management Consultant is NOT a manager.
A TN management consultant is an extra person who "consults" to management.
A TN management consultant has an expertise that management needs.
A TN management consultant is someone who responds with an answer when Management asks a question.
A TN Management consultant can do research to get the answer.
A TN Management Consultant answers questions, observes staff, observes operations, observes everything and THEN writes a report or gives an oral report to management who then implement the new process, new policy, new procedure suggested to management by the managemnt consultant.
Many people get Management Consuiltant TN visas and then show up at the border with a business card that says "manager" of something and have their TN Visa pulled.
A TN Managemetn consultant simply needs to prove five years experience in the field they are going to consult in.
A TN Management Consultant does NOT ever have to have been a managemnt consultant in the past.
Therefore, someone who worked with a process for five years as an employee in Canada or Ethiopia or Chile (if they are a Canadian) can be a consultant to a company needing a person who is an expert in that process even if they have never been a consultant before. I mention Ethiopia and Chile because we have sent people with experience in gold extraction in Ethiopia and Chile to the States as management consultants.
Getting as many letters from past supervisors, managers or fellow workers is posibly the best you can do. This is not unusual in the dot.com meltdown where copmpanies were disappearing on a daily basis.
