Too many people were getting them for identification purposes with no intent to file a return. The new rules have you file the return with a filled in W7 attached. The guidance, posted at http://www.irs.gov/individuals/article/0,,id=120219,00.html, provides detailed information and instructions to help qualifying applicants obtain ITINs without added burden. IRS's new measures help ensure the numbers are issued and used for the intended tax administration purpose. The IRS will issue ITINs to qualifying foreign individuals who have completed the Forms W-7 or W-7SP (Spanish version), Application for Individual Taxpayer Identification Number. They must also demonstrate a tax need for the numbers. Individuals who need ITINs to request reduced withholding on Form 8288-B, Application for Withholding Certificate for Dispositions by Foreign Persons of U.S. Real Property Interests (FIRPTA), or pay the tax via Form 8288, U.S. Withholding Tax for Dispositions by Foreign Persons of U.S. Real Property Interest, should attach the Form W-7 to these forms and mail the documents to: Internal Revenue Service Philadelphia Service Center ITIN Unit, P.O. Box 447 Bensalem PA 19020. On the Form W-7, a request for an ITIN to either pay Foreign Investment in Real Property Tax Act (FIRPTA) withholding or to request reduced FIRPTA withholding falls under "h. Other," and is described as "Exception 4" on page 3 of the instructions. An individual who meets "Exception 4" should check Box "h" in the section of Form W-7 marked "Reason you are submitting Form W-7," and write "Exception 4" in the write-in area to the right of the box.
