hi david
my client is an australian citizen and is the fiance of my male
client who is canadian
citizen. she has been here since march 21/03 and her visa
expires mar 21/04. they
are both returning to australia in april to get married and will
be returning april 2005.
she worked all of 2003. does she file a cdn return (prorating
exemptions) for 2003 and
for jan to date of departure 2004 before she leaves?

Your Australian has to file her return for 2003 from Mar 21 to
Dec 31 and you will prorate her exemptions.
For 2004, she will file one from Jan 1 to April ??, 2004, the day
she leaves the country.
However, she will be illegal when her visa expires and if she
wants to come back to Canada, she should file for a change in
status to be a visitor for that extra month.
She does this by filing form IMM1249 which she can find and fill
in at.

She should get the form in right away and for sure a month BEFORE
her current visa expires.
She needs to pay her fee by getting an official receipt at:
