Im hoping you can find the time to answer mine as Ive been searching the interenet for this answer for days. (having no luck whatsoever). I have a friend, and no its not me, who has her boyfriend visiting from New Zealand. He has been here for six months and wants to stay longer. His plane ticket is open for a year, which is confusing to me as as I understand it ...is only allowed to visit Canada for 6 months at a time. What my question is, after ive babbled way too long for such a busy man ....Is he still legal to stay here? as he doesnt want to piss off immigration , he is eventually going to move here if accepted . If you cant find the time, I totally understand and will do my best to keep searching the internet . Thank you so very much for your time ...im going to put your addy in my book as I too will need info ...ill be moving to United States in July of 2004. Merry Christmas and Happy New Year!!!! Sincerely, DXXXXXXXXXX david ingram replies: His passport should have an expiration date stamped in it. Actually, it probably won't. Citizenship & Immigration Canada's explanation of how you determine the expiry date of your temporary status in Canada is on page 5 of the Guide at http://www.cic.gc.ca/english/pdf/kits/guides/5551E.PDF However, visitors from visa-exempt countries such as New Zealand often do not have their passports stamped at all. If it has passed, he is illegal and should go if he wants to keep everyone happy. Or he could apply for what is called "restoration" of his visitor status. Maybe make a trip to Seattle and back which would / could renew and / or give him another six months. Leaving Canada for a few hours or days does not assure re-admission to Canada for another 6 months. What it DOES do is to expose the applicant to examination by an Immigration Officer which can result in admission for 6 months, refusal of admission or admission for a very short period to make arrangements to leave Canada. The procedure for applying for extension (and/or restoration) of visitor status without leaving Canada is described in the Guide I mentioned above. If his visa time has not expired, he should go to: http://www.cic.gc.ca/english/applications/visitor.html And apply for a visitor's extension. He should do this 3 weeks before his time is up.
