American with New York State Pension building 1/2 year
QUESTION: I am a retired US citizen. I receive a non-taxed New York State Pension. I am building a home in Quebec as a retirement home and plan on living there at least 6 months. Will I have to file and pay Canadian income tax on my pension? =============================================== david ingram replies: Let's use the word "visiting" there for six months of the year. "Living there" implies the right of Canada to Tax you. However, if you are only in Canada for 5 and a half months and keep accurate records and know where you are, then Canada will not tax you if you are here less than 183 days a year. However, if you were a Canadian with a Florida or Pal springs or Corpus Christie Condo and were spending more than 125 days a year for three years in a row, You must file a US tax return and form 8840 to try and get yourself out of US tax. (of course, if you are in the US more than 183 days, the IRS WILL TAX the Canadian just as Canada will tax an American in Canada more than 183 days.
