Canadian with H1B wants to change jobs in California
This is a multi-part message in MIME format. ---------------------- multipart/alternative attachment QUESTION: I'm a Canadian who came to a job in Los Angeles with a TN visa and you = have been very helpful with handling my taxes to date. I finally got = the employer to convert to an H1B and to cooperate with a Green Card = process (they wouldn't pay for it). That's just started (they're = advertising), however, I'm increasingly unhappy in this job and want to = see if I can find something that would contribute to, rather than = derail, my career. If I can get another job offer, how should I handle = the issue of visas/permanent residence? Should I tell them they can get = me faster with a TN (and would I have to go to the border to get it?) or = should I request that they get an HIB and if they're in a hurry, to pay = the extra for premium processing? Since most of the employers in my = field are non-profits, it's not like they have corporate-size budgets, = but the prospect of four more years in my present job (the time it's = predicted to take before the Green Card is bestowed) is pushing me to = try to find something more suitable--if anyone is desperate enough for = clinicians to go through the whole rigmarole in order to hire me. I = realize that if I just sit tight for four more years, I can work = anywhere I want, but four years (after 2 1/2 already) of career detour = when one is in one's fifties is perhaps too high a price to pay! What are your thoughts on this question? =3D=3D=3D=3D=3D=3D=3D=3D=3D=3D=3D=3D=3D=3D=3D=3D=3D=3D=3D=3D=3D=3D=3D=3D=3D= =3D=3D=3D=3D=3D=3D=3D=3D=3D=3D=3D=3D=3D=3D=3D=3D=3D=3D=3D=3D=3D=3D=3D=3D=3D= =3D=3D=3D=3D=3D=3D=3D=3D david ingram replies: A TN does not get you dual status and the H1B is the only way to go, = particularly if the other application is already started.=20 There is a provision now to move from one employer to another with an = H1B but I understand that about 1 in 5 is being turned down and then you = would be "out of there". Do NOT go without the H1B in place (in my = opinion). Expedited processing is the only way to go.
